1. Acceptance of Terms

By accessing or using Statues AI ("Service"), operated by Statues AI LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.

2. Description of Service

Statues AI provides AI-powered generation of 3D models and physical 3D-printed sculptures. Users can describe desired sculptures in text, and our AI creates digital 3D models that can be purchased as physical prints.

3. User Responsibilities and Prohibited Content

You are solely responsible for the content you generate using our Service. You agree NOT to create, request, or submit content that:

  • Infringes intellectual property: Copyrighted characters, logos, trademarked designs, or any content owned by third parties (e.g., Disney characters, sports team logos, brand mascots, video game characters)
  • Violates publicity rights: Likenesses of real people, living or deceased, including celebrities, public figures, athletes, musicians, actors, or any identifiable individual without their explicit written consent
  • Contains offensive material: Hateful, violent, sexually explicit, defamatory, or otherwise objectionable content
  • Violates any law: Content that would be illegal to produce, distribute, or possess in any applicable jurisdiction
  • Misrepresents origin: Content falsely suggesting endorsement by or association with any person or entity

4. Content Review and Refusal

We reserve the right, but have no obligation, to review any content generated through our Service. We may refuse to produce, cancel, or refund any order at our sole discretion if we believe the content violates these Terms or is otherwise objectionable. We may also report illegal content to appropriate authorities.

5. Intellectual Property

Your Content: You retain ownership of the original text prompts you submit. For AI-generated 3D models created from your prompts, you receive a non-exclusive license to use, display, and create physical copies for personal use.

Our Content: The Service, including its design, code, and pre-made catalog items, remains our property or the property of our licensors.

AI-Generated Content: The legal status of AI-generated works is evolving. We make no guarantees regarding copyright protection for AI-generated models.

6. Indemnification

You agree to indemnify, defend, and hold harmless Statues AI LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Content you generate or request through the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or publicity rights

7. DMCA and Takedown Requests

If you believe content on our Service infringes your copyright or other intellectual property rights, please contact us at legal@statuesai.com with:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing content and its location
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate
  • Your physical or electronic signature

8. Payments and Refunds

All payments are processed securely through Stripe. Prices are displayed in USD and include applicable taxes where required. Refunds are handled on a case-by-case basis. We will replace or refund items that arrive damaged if reported within 48 hours of delivery with photo evidence.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR FREE OF ERRORS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATUES AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. Material changes will be communicated via email or prominent notice on the Service.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
